The terms that govern your use of our website — including requests for quote, your submissions, and your rights and responsibilities. Please read them carefully.

Agreement to These Terms

These Terms of Service ("Terms") govern your access to and use of the website operated by Modern Mold & Tool ("Modern Mold & Tool," "we," "us," or "our"), including all content, tools, and services made available through it (collectively, the "Site").

By accessing or using the Site — including by submitting a Request for Quote (RFQ), downloading a resource, or otherwise interacting with us — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

These Terms include important provisions that limit our liability, disclaim warranties, and govern how disputes are resolved. Please read them carefully.

Eligibility and Business Use

The Site is intended for business and professional use. By using it, you represent that you are at least 18 years old and that, where you act on behalf of a company or other entity, you have authority to bind that entity to these Terms. "You" refers to you and any entity you represent.

The Site and What It Offers

The Site provides information about our injection molding, tooling, and related manufacturing capabilities, along with tools and resources such as RFQ forms, a material selector, downloadable resources, and editorial content.

The Site is provided for general informational purposes. We may add, change, suspend, or discontinue any part of the Site at any time, with or without notice.

Requests for Quote; No Binding Offer

Submitting an RFQ or other inquiry through the Site is a request for information only. It does not create a contract, reserve production capacity, or obligate either party.

  • Any quote, estimate, price, lead time, or capability statement we provide is for evaluation purposes, is subject to change, and is not an offer capable of acceptance.
  • A binding agreement is formed only through a separate written agreement, purchase order, or order acknowledgment that we sign or expressly accept.
  • In the event of a conflict, the terms of that separate agreement — not these Terms — govern the production of parts, tooling, or services.

Your Submissions and Confidentiality

When you submit information or files through the Site — for example contact details, project requirements, CAD models, or engineering drawings ("Submissions") — you represent that you have the right to provide them and that they do not infringe any third party's rights or violate any law or obligation.

You grant us a non-exclusive, worldwide, royalty-free license to use, store, reproduce, and process your Submissions for the purpose of responding to your inquiry, preparing quotes, and providing requested services. We handle personal information as described in our Privacy Policy.

Unless we have signed a separate written confidentiality or non-disclosure agreement with you, Submissions are not treated as confidential or proprietary. Please do not send trade secrets or other sensitive information through the Site without a signed NDA in place.

Acceptable Use

You agree not to:

  • Use the Site for any unlawful, harmful, or fraudulent purpose
  • Upload or transmit malware, or attempt to gain unauthorized access to the Site, accounts, or systems
  • Interfere with or disrupt the Site, including by overloading it, scraping it, or using automated means to harvest data without our written permission
  • Reverse engineer, decompile, or attempt to derive the source code of the Site
  • Submit content that is infringing or defamatory, or that you do not have the right to submit
  • Misrepresent your identity or affiliation, or submit false information

Restricted Areas

Certain areas of the Site, such as administrative tools, are restricted to authorized users. You must not attempt to access them without authorization. If you are given credentials, you are responsible for keeping them confidential and for activity under your account, and you must notify us promptly of any unauthorized use.

Intellectual Property

The Site and its content — including text, graphics, logos, images, designs, and software — are owned by or licensed to Modern Mold & Tool and are protected by intellectual-property laws. "Modern Mold & Tool," our logos, and related marks are our trademarks and may not be used without our prior written permission.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your internal business evaluation. Except as expressly permitted, you may not copy, reproduce, distribute, modify, or create derivative works from the Site or its content.

Technical Information and Tools

Material data, specifications, capability sheets, the material selector, and similar resources on the Site are provided for general guidance only. They are estimates, may be incomplete, may not reflect your specific application, and may change.

They are not engineering, design, or professional advice, and they are not a substitute for your own analysis and testing. You are responsible for verifying that any material, process, or result is suitable for your intended use, and we recommend you confirm critical requirements with us in writing.

Third-Party Links and Services

The Site may contain links to third-party websites, resources, or services that we do not control. We provide them for convenience only and are not responsible for their content, products, or practices. Your use of third-party sites is governed by their own terms and policies.

Disclaimer of Warranties

THE SITE AND ALL CONTENT, TOOLS, AND RESOURCES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement, and we do not warrant that the Site will be uninterrupted, secure, error-free, or that any content or calculation is accurate, complete, or current. This section does not affect any warranties expressly set out in a separate written agreement for the supply of parts, tooling, or services.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MODERN MOLD & TOOL AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE.

Our total liability for all claims relating to the Site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. These limits do not apply to liability that cannot be excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless Modern Mold & Tool and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Site, your Submissions, or your breach of these Terms or of any law or third-party right.

Suspension and Termination

We may suspend or terminate your access to the Site at any time, with or without notice, including if we believe you have violated these Terms. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

The exclusive venue for any dispute arising out of or relating to these Terms or the Site will be the state and federal courts located in Massachusetts, and you consent to their personal jurisdiction. Before filing any claim, you agree to first contact us and attempt in good faith to resolve the dispute informally.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above, and we may note material changes here. Your continued use of the Site after the changes take effect constitutes acceptance of the revised Terms.

General

  • These Terms, together with our Privacy Policy and any separate written agreement between us, are the entire agreement regarding your use of the Site.
  • If any provision is found unenforceable, the remaining provisions will remain in full effect.
  • Our failure to enforce a provision is not a waiver of it.
  • You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
  • You consent to receive communications from us electronically, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.
